Terms of service.
The terms on which Eastgate Medical Services makes this website available to you. Please read them before using the site or sending us an enquiry.
This website is an information and enquiry channel for healthcare professionals and institutional buyers. Nothing is sold, ordered or paid for here.
Nothing on this site is medical advice, and product listings are not an offer to sell. Availability and regulatory status vary — always confirm with us in writing before you rely on anything.
Any actual supply of products or services is governed by a separate signed agreement, quotation or purchase order, not by these terms.
01 Acceptance of these terms
This website at eastgatemedical.net is operated by Eastgate Medical Services ("Eastgate", "we", "us", "our"), a company established in the State of Qatar in 2016 with its office at Barwa Avenue Street, Safwa Building, Block No. 26, 2nd Floor, Office No. 201, PO Box 16283, Doha, Qatar.
By accessing or using this website you agree to be bound by these Terms of Service. If you do not agree to them, please do not use the site.
We may amend these terms from time to time. The version published on this page at the moment you use the site is the version that applies to that use.
02 Definitions
- Site
- The website published at eastgatemedical.net, including all pages, text, images and files served from it.
- Content
- All material on the Site, including text, product descriptions, illustrations, photographs, logos, layout and code.
- Products
- The medical devices, surgical consumables, pharmaceutical products and aesthetic systems described on the Site.
- You
- Any person or organisation accessing or using the Site.
- MoPH
- The Ministry of Public Health of the State of Qatar.
03 Who this website is for
The Site is intended for healthcare professionals, hospital and clinic procurement teams, institutional buyers, regulators and prospective manufacturing partners. It is a business-to-business resource.
It is not intended for patients or the general public seeking treatment, and it is not a consumer sales channel. Product information is presented on the assumption that the reader has the professional training to interpret it.
You must be at least 18 years old to use the Site, and where you use it on behalf of an organisation you confirm that you are authorised to do so.
04 No medical advice
Product descriptions on the Site are commercial summaries. They are not clinical guidance, they are not complete, and they do not describe every indication, contraindication, warning, precaution or adverse effect.
Before any Product is used, the responsible healthcare professional must read and follow the manufacturer's current instructions for use, labelling and technical documentation, and must satisfy themselves that the Product is appropriate for the intended patient and procedure. If there is any conflict between this Site and the manufacturer's documentation, the manufacturer's documentation prevails.
If you are a patient, please speak to your own doctor. We cannot advise on individual cases.
05 Product information & registration
We take care to describe our portfolios accurately, but Content on the Site is provided for general information and is subject to change without notice.
- Listing is not an offer to sell. The presence of a Product on the Site does not mean it is currently in stock, currently distributed by us, or available to you.
- Regulatory status varies. Products must be registered with, or otherwise cleared by, the MoPH before they may be supplied in the State of Qatar. Registration status differs between products and changes over time. A Product shown on the Site may not be registered or available at any given moment.
- Availability differs by market. Products approved in one jurisdiction may not be approved in another. Nothing on the Site is an offer to supply in any country where doing so would be unlawful.
- Specifications belong to the manufacturer. Technical specifications, images and performance claims originate with the manufacturer and may be updated by them at any time. Images are illustrative and may not depict the exact configuration supplied.
Always confirm current availability, configuration and registration status with us in writing before relying on it — for a tender submission, a clinical plan, a budget or a purchase decision.
06 Enquiries, quotations & orders
The enquiry form and the contact details on the Site are a way to start a conversation. Sending an enquiry does not create a contract, reserve stock or oblige us to supply anything.
- A quotation we issue is an invitation to treat, valid only for the period and on the terms stated in it, and may be withdrawn or revised at any time before acceptance.
- A binding contract arises only when we expressly accept a purchase order in writing, or when both parties sign a supply, tender or service agreement.
- Any supply of Products or services is governed by that separate agreement — together with the applicable purchase order, delivery terms and manufacturer warranty — and not by these Terms of Service. Where the two conflict, the separate agreement prevails.
- You are responsible for the accuracy of the information you send us. We rely on it when quoting and when checking regulatory suitability.
Please do not send patient-identifiable information or clinical records through the website form. See our Privacy Policy.
07 Acceptable use
You may view, browse and print pages from the Site for your own internal business or professional purposes. You may quote short extracts if you attribute them to Eastgate Medical Services.
You must not:
- Use the Site for any unlawful, fraudulent or misleading purpose, or in breach of any applicable law or regulation.
- Copy, republish, redistribute or commercially exploit substantial parts of the Content without our prior written permission.
- Systematically extract data from the Site by scraping, crawling, harvesting or any similar automated means.
- Submit false, misleading or impersonated information through the enquiry form, or use it to send unsolicited commercial messages.
- Introduce any virus, malware or other harmful code, or attempt to gain unauthorised access to the Site, its server or any connected system.
- Interfere with the proper working of the Site, including by any denial-of-service or overload attempt.
- Remove, obscure or alter any copyright, trademark or other proprietary notice.
We may restrict or withdraw access to the Site, without notice, from anyone we reasonably believe is in breach of this clause.
08 Intellectual property
All intellectual property rights in the Site and its Content — including the Eastgate name, the Eastgate logo and mark, the page designs, the written copy, the illustrations and the underlying code — belong to Eastgate Medical Services or to our licensors, and are protected by the laws of the State of Qatar and by international treaties.
Nothing on the Site grants you any licence or right to use those materials except as expressly permitted in clause 07.
Third-party trademarks
The names, logos and marks of our manufacturing partners shown on the Partners page and elsewhere on the Site are the property of their respective owners. They are reproduced to identify the manufacturers whose products we distribute. Their appearance on the Site does not imply that those owners endorse Eastgate beyond the distribution relationship, and it grants you no right to use them.
09 Third-party links & content
The Site links to third-party websites, including our aesthetics microsite at eastgate-aesthetics.com, our partners' websites, our social media profiles, and an embedded map provided by Google.
We provide those links for convenience. We do not control third-party sites and we are not responsible for their content, their availability, their accuracy or their privacy practices. Following an external link is at your own risk, and the terms and policies of that third party will apply once you leave our Site.
10 Availability of the site
We aim to keep the Site available, but we provide it on an "as available" basis and give no guarantee of uninterrupted or error-free access. We may suspend, withdraw, restrict or change all or part of the Site — including any Content — at any time and without notice, for maintenance, security or business reasons.
We are not liable to you if the Site is unavailable at any time or for any period.
11 Disclaimers & liability
To the fullest extent permitted by applicable law, the site and its content are provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement.
We do not warrant that the Content is complete, current or free from error, or that the Site is free from viruses or other harmful components.
To the fullest extent permitted by applicable law, Eastgate Medical Services, its directors, employees and agents shall not be liable for:
- Any indirect, incidental, special, consequential or punitive loss.
- Any loss of profit, revenue, business, contract, goodwill, anticipated saving or data.
- Any loss arising from your reliance on Content that has since changed, including availability, specification or regulatory status.
- Any loss arising from a third-party website, service or embedded content reached through the Site.
- Any loss arising from unavailability of the Site.
Where liability cannot lawfully be excluded, our total aggregate liability arising out of or in connection with your use of the Site shall not exceed QAR 5,000.
12 Indemnity
You agree to indemnify and hold harmless Eastgate Medical Services, its directors, employees and agents against any claim, loss, liability, cost or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the Site, or your infringement of any third-party right through your use of the Site.
13 Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these terms. By using the Site and submitting an enquiry you confirm that you have read it.
14 Governing law & jurisdiction
These Terms of Service, and any dispute or claim arising out of or in connection with them or with your use of the Site (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of the State of Qatar.
The courts of the State of Qatar shall have exclusive jurisdiction to settle any such dispute or claim.
15 General
- Severability. If any provision of these terms is held to be invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision shall be treated as modified to the minimum extent necessary to make it enforceable.
- No waiver. If we do not insist that you perform any obligation under these terms, or delay in enforcing a right against you, that is not a waiver of that right.
- Entire agreement. These terms, together with our Privacy Policy, are the entire agreement between us in relation to your use of the Site. They do not affect any separate supply, tender, distribution or service agreement between us.
- Assignment. You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours to a successor of our business.
- Third parties. No person other than you and Eastgate Medical Services has any right to enforce these terms.
- Language. These terms are published in English. If we issue an Arabic translation and there is any inconsistency, the version designated as authoritative in that translation shall prevail.
